Terms of Use
1. Introduction
These Terms of Use ("Terms") govern your access to and use of accelerateautomation.ai (the "Site") and the services provided by Accelerate Automation LLC, a Texas limited liability company ("Accelerate Automation," "we," "us," "our"). By using the Site or our services you agree to these Terms. If you do not agree, do not use the Site or our services.
2. Services
Accelerate Automation builds and operates done-for-you AI automation, lead capture, CRM workflows, websites, and related growth systems for service businesses, primarily in the Dallas, Texas area. The specific scope of work for any client is defined in a separate written agreement, statement of work, or engagement summary. These Terms apply in addition to any such agreement; in case of conflict, the engagement-specific document controls.
3. Account and Eligibility
You must be at least 18 years old and authorized to enter into agreements on behalf of your business to use our services. You are responsible for keeping login credentials and account information accurate and secure.
4. Acceptable Use
You agree not to use the Site or our services to: (a) violate any law or third-party right; (b) send spam, unsolicited messaging, or content that violates the Telephone Consumer Protection Act, CAN-SPAM, or similar laws; (c) attempt to gain unauthorized access to our systems or any third-party system; (d) interfere with the operation of the Site or our services; or (e) misrepresent your identity or affiliation.
5. Fees, Payment, and Refunds
Setup fees and recurring retainers are stated in your engagement document. Setup fees are non-refundable once work has begun. Monthly retainers are billed in advance and are non-refundable for the current billing period. We may suspend services for non-payment after reasonable notice.
6. Cancellation
Monthly retainers may be cancelled with 30 days written notice to robin@accelerateautomation.ai. Cancellation takes effect at the end of the then-current billing period. Setup fees and any work already performed remain payable.
7. Data Ownership and Portability
All systems, automations, contacts, conversations, and business data created in your GoHighLevel sub-account or other client-owned platforms are owned by you. We retain no proprietary claim to your business data. On termination, you keep your sub-account, your data, and your tools.
8. Intellectual Property
We retain ownership of our underlying methodology, templates, snapshots, training materials, and any non-client-specific assets we use to build your system. You receive a non-exclusive, non-transferable license to use the configured system for your business as long as you remain a client. Our brand, logos, and Site content are our property and may not be reproduced without permission.
9. Third-Party Services
Our services rely on third-party platforms including but not limited to GoHighLevel, Calendly, Google Workspace, OpenAI, Anthropic, Twilio, and Stripe. Your use of those platforms is also governed by the third-party providers' terms. We are not responsible for outages, changes, or actions of those providers.
10. Disclaimers
The Site and our services are provided on an "as is" and "as available" basis. We do not guarantee specific business outcomes, lead volumes, conversion rates, or revenue results. AI-generated outputs may contain errors and should be reviewed before use. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will Accelerate Automation, its members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities, arising from or related to the Site or our services. Our total aggregate liability for any claim shall not exceed the fees you paid to us in the three months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Accelerate Automation, its members, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Site or our services, your business operations, your violation of these Terms, or your violation of any law or third-party right.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising under or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms at any time. The current version is always posted on this page with an effective date. Continued use of the Site or our services after a change constitutes acceptance of the updated Terms.
